A word about the book ........................... "Man is a social being, living in a society. And each person is expected to respect the right of his neighbour and the other members of the society. Right of easement is as old as the right to property. Some lands have servitudes in favour of others tenements. Such properties are described as servient heritage, burdened with obligation towards more favoured dominant heritage. Such obligations and favours are essential needs of the society for a peaceful coexistence and concomitance. Servitudes in respect of adjacent lands had originated in Roman law, and found its place in ancient Common Law as well, and also had its significance in Hindu and Mohamedan law. The colonial legislators had in 1882 come up with a slew of legislations concerning rights to property, its transfer, enjoyment, authorisation and preservation. The Indian Easements Act was one such important statute legislated in the year 1882 together with other important statutes like, the Transfer of Property Act, the Powers-of-Attorney Act, the Indian Trusts Act and the Presidency Small Cause Courts Act. Laws on easement and licence still assume great importance in civil litigations in our country, and are subjects which practising advocates and judges need to keep abreast of. Shri Ajith N, is an Advocate practising in the High Court of Kerala, with a lot of trial Court experience. He is very dedicated to his profession and has the academic bend of mind to have authored about 25 books both on civil and criminal side, which were all well received, and enjoy discerning approbation, both by the Bench and the Bar alike. I have personally referred to and studied most of his books and find it extremely helpful, lucid and enlightening. I appreciate the manner in which Shri Ajith has been dealing with the different subjects. Shri Ajith N has come up with this fourth edition of the Laws on Easements; each edition better than the earlier ones and has been updated with all the precedents. lucid notes, and has also added the relevant extracts of the related legislations, bearing in mind the development in these fields of jurisprudence. He deserves to be congratulated for his effort, I sincerely hope that this edition of the book too would continue to serve the judicial fraternity as did the earlier editions in elucidating the subject.
